Terms of Service

1. Service Description

FamilyPet+ (the "Service") is a mobile application and related online services that allow pet owners to manage health tracking, walks, community features and backups of their pets' information.

The Service is operated by: Alexis GUILLAUME, hereinafter the "Publisher".

2. Acceptance

Use of the Service implies full acceptance of these Terms. A user who does not accept them must stop using the Service.

Acceptance is materialized by creating an account and explicitly checking "I have read and accept the Terms of Service and the Privacy Policy".

3. Account creation

  • The user must be at least 15 (parental consent required below — see Privacy Policy).
  • Information provided must be accurate and up to date.
  • Passwords are strictly personal. The user is responsible for any activity from their account.
  • The Publisher may refuse or suspend a registration in case of manifestly fraudulent use.

4. Features

The Service notably includes:

  • Pet profile management (species: dog, cat, exotic, etc.)
  • Digital health booklet and vaccination reminders
  • Recording and history of geolocated walks (opt-in)
  • Community module (forum, photo sharing)
  • Push notifications
  • Data export and backup

Some features may be offered as beta or experimental and are then clearly labeled; they are provided without continuity guarantee.

5. User obligations

The user undertakes to:

  • Comply with applicable laws, including animal welfare regulations.
  • Not publish unlawful, abusive, defamatory, hateful, sexual, or rights-infringing content.
  • Not attempt to bypass security measures, perform mass scraping, reverse engineering, or attacks on the infrastructure.
  • Not use the Service for unauthorized commercial activities without written agreement.

Any breach may lead to account suspension or deletion without notice and without refund.

6. User-generated content

The user retains ownership of all content they publish.

To operate the Service, the user grants the Publisher a non-exclusive, worldwide, royalty-free license, limited to the account's lifetime, solely for hosting, displaying, and transmitting the content to recipients chosen by the user.

This license terminates when the content or account is deleted.

7. Intellectual property of the Service

The "FamilyPet+" trademark, logo, interfaces, databases, scripts and source code remain the exclusive property of the Publisher. Any unauthorized reproduction is prohibited.

8. Availability — Limitation of liability

The Publisher uses reasonable means to ensure availability but does not guarantee uninterrupted service (maintenance, third-party AWS incidents, etc.).

The Service is provided "as is". The Publisher cannot be held liable for:

  • medical decisions made by the user based on information displayed in the application (the Service does not replace a veterinary consultation);
  • data losses due to non-compliant use or force majeure;
  • content published by other users in community spaces.

The Publisher's total liability, all causes combined, is capped at the amount paid by the user during the last 12 months (or 50 EUR for free accounts).

9. Personal data

Processing of personal data is governed by the Privacy Policy, also accessible in-app via /privacy/policy. It is an integral part of these Terms.

10. Termination

  • By the user: at any time via /auth/account, without notice or reason.
  • By the Publisher: in case of serious breach, after written notice to the account email, except in case of emergency (security, manifest illegality).

After termination, data is erased within the periods stated in the Privacy Policy (30 days).

11. Changes to the Terms

Any material change will be notified in-app at least 30 days before taking effect. Continued use after that date constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute is submitted to the competent courts of the Publisher's registered office, unless a mandatory consumer-protection provision states otherwise.

Before any litigation, the parties undertake to seek an amicable solution. Consumers may use the European online dispute resolution platform for free: ec.europa.eu/consumers/odr.
